Equipment Rentals and Reminders (Disclosure:  Garage does have video equipment and alarm for security purposes)
ALL EQUIPMENT IS USED AT YOUR OWN RISK.  LOVIN LIFE IS NOT RESPONSIBLE FOR ANY INJURY ASSOCIATED WITH EQUIPMENT USE. - AGREEMENTS AND WAIVERS MUST BE SIGNED BEFORE ACCESS WILL BE GIVEN.
 
Golf Cart - Seats two in the front and has an area in the back where you can put your supplies.  You must be 21 and possess a valid driver's license and insurance as required by law.  PLEASE DO NOT LET YOUR CHILDREN DRIVE THE GOLF CART.  OUR NEIGHBORS DO CALL US AND COMPLAIN. 

• Paddle Boat - You can fit 4 TO 5 persons in the paddle boat.  We supply 4 adult and 3 child life jackets.  Please bring your own if those do not meet your needs.   DO NOT LEAVE THE PADDLE BOAT IN THE WATER AFTER USE.  IT MUST BE BROUGHT UP ONTO SHORE and placed in the racks as shown in the picture below.  During the summer months, the paddleboat can stay down at our docks on the racks and does not need to be brought back and forth from the garage.  ​

*JET SKI AND KAYAKS ARE NOT OURS AND NOT AVAILABLE.

• Noodles/Rafts - You may take the noodles and rafts to the lake, please return to garage each day after use.
• Inner-tube/rope -  You may use the inner-tube during boating season ONLY.  Inner-tube and tow rope are to be returned to garage each day after use.  You are responsible for inner-tube.  Riders must use an approved "life vest" the life jackets are not acceptable.   Pulling inflatables under bridges is prohibited on Deep Creek Lake.  If the inflatable breaks/punctures, there will be a $350. replacement fee.   $50.00 fee for missing, lost or damaged rope. 
•  Bikes -  We have 5 bikes.  Helmets are not supplied, you must bring your own helmets.   
• Fishing Rods -  You must supply your own bait and tackle.​

 Please read carefully before signing. A separate application & contract must be completed for every individual who will operate the rented golf cart
 
In consideration for the rental of equipment provided by Elajenta, LLC DBA Lovin Life. I agree to the following conditions. In the event that I violate any of the following conditions, I agree and understand that further use of the equipment may be revoked immediately and without notice:
 
1. I promise to return the equipment to the location provided immediately upon completion of the rental period in as good condition as I received the same, normal wear and tear accepted. I will operate the equipment safely and responsibly, and I will preserve and protect the equipment from loss or damage, my person or property, and the persons or property of others. I agree and understand failure to comply with the terms of this agreement will result in a forfeiture of my rental fees and deposit. I agree to be legally and financially liable for all costs of repairs to the equipment and for the loss, damage and/or injuries to my person or property and the persons or property of others regardless of fault. I agree to reimburse the owner for such unrecoverable costs, including but not limited to deductibles and any uninsured losses.
 
2. I agree to hold harmless, defend and indemnify Elajenta, LLC DBA Lovin Life and it's members/owners, for any and all damages and claims of any nature whatsoever that may arise from the use of said equipment during the time of the rental period, including but not limited to claims for damages to the equipment, my person and property and the persons and property of others.
 
3. I agree to become familiar with the operation and use of equipment and regulations, to read any instructions provided to me regarding the equipment, and to operate/utilize the equipment in accordance with said instructions. I agree to contact ELAJENTA, LLC DBA LOVIN LIFE if I have any questions or concerns about operating the equipment or if my guest or I have caused any damage to the equipment or others through the use of the equipment. I agree to examine and inspect the safety and mechanical condition of the equipment, reporting any concerns or problems before using the equipment.
 
4. I understand that a golf cart is subject to the same laws and regulations pertaining to motor vehicles and therefore agree that the golf cart will be operated in accordance with the laws of the Commonwealth of Maryland and the local laws of Garrett County, including but not limited to the requirement that persons driving the golf cart must not be under the influence of alcohol and/or illegal drugs. I further agree that I personally will be responsible for all moving and/or parking violations issued to said cart while it is in my possession, under my control, or at any time during the house rental period.  I agree that I will not operate the golf cart at night or allow water to come in contact of mechanical or electrical components. I further agree that law prohibits me from using the golf cart on or along Highway and agree to keep the golf cart within Harvey’s Peninsula.  Highlighted map provided in welcome book.
 
5. I agree that only persons who are 21 years or older, possess a valid driver’s license and insurance as required by law shall be permitted to drive the golf cart. I further agree that the maximum occupancy of the golf cart is four persons, including children.
 
6. I agree the privilege of using the golf cart can be revoked without notice by ELAJENTA, LLC DBA LOVIN LIFE in their sole discretion, for any violation of this agreement. I further agree I shall not be entitled any rental refund or deposit for such revocation of privilege.

7.  I will at all times ensure all proper safety gear is utilized when operating or utilizing equipment by myself and my guests.  It is my responsibility to know all safety requirements with equipment prior to use and to review the safety documents provided below.  

8.  All boating regulations must be followed when using the inner-tube on the lake.  Inner-tube is only allowed on the lake during during the spring and summer seasons.  The inner-tube is not to be used in the snow or as a trampoline.  You are required to familiarize yourself with the boating rules and regulations of the state of Maryland.  See ​Maryland Licensing and Regulations.  I agree to hold harmless, defend and indemnify Elajenta, LLC DBA Lovin Life and it's members/owners, for any and all damages and claims of any nature whatsoever that may arise from the use of said equipment during the time of the rental period, including but not limited to claims for damages to the equipment, my person and property and the persons and property of others.

By my signature below, I certify that I understand and agree to the conditions set forth in the ELAJENTA, LLC DBA LOVIN LIFE Binding Equipment Rental Agreement. By signing below, I attest that I have read and I understand each of the safety manuals listed below as well as the Maryland boating/fishing regulations. I acknowledge that I have signed this document voluntarily and freely and that my electronic signature creates a contractual obligation that binds me, my guests and all passengers.
